TFS 2013 - How to create a label with a Gated Build

we switched several of our builds on triggered gated check-in realize a build label not generated with build.   no problem say,  we can figure out.... not!

even though label source build parameter set true vs. false , field active (not greyed out), the gated build not seem create label.  since "black boxed" can't seem override conditional logic prevents label generated.

next... i looked at adding labelworkspace build.  seems option.  after build should have arguments needed execute labelworkspace.   again.... tfs 2013 "black box" here stuck trying figure out how generate label gated build.  

i need command override conditional "do not create label" logic or a example showing me how best populate the workspace , scope parameters of build label.  can create own arguments and populate them but, creates more maintenance me.

for generating label gated build, might need customize build process template used in buidl definition. add custome build activity build process template creation done. can check page to see if replies helpful. or can create label manually before or after building if it's available scenario.
